A Theory is ABOVE Facts. If something is "theoretical" it means that while it might not be shown true yet, literally all of the Facts are telling us it is.
I hate Game Theory for many reasons, but that's just one of them.

The word Theory has more than one definition, and "This is the best possible answer given all the facts we have available" is only ONE of those definition. It is very clear by his tagline "But hey, that's just a theory, a GAME THEORY" he is using Theory in it's usage in line more with definitions 2, 6, and 7.
You can not just decide to ignore one appropriate definition of a word in favor of a different definition that fails to fit into context so that you can then complain that the word is being used improperly.
