Not a lawyer myself, but... It's not, they just don't know that and are afraid. I mean, speaking from a US perspective, and the rest of the western world generally gets dragged along with US copyright law. The ruling on The Wind Done Gone basically settled that - that novel was even being sold, and it was still found that it fell within the doctrine of fair use. Maybe in the UK or whatever it's different, but if they host the website in the US, nothing's going to come of it. I mean, think about it. If what's being done *here* falls under fair use, what's being done there definitely would.
I'd be more concerned about them apparently having "no way of stopping" people from posting non-MC stories, though.
