Taken together, there is a clear lack of mens rea that can be easily established, making her actions absolutely not assault. Depending on the kinds of circles this succubus usually runs in, the first part may or may not be a reasonable belief. If she tends to avoid mortals because she is all too aware of how her passive aura affects them, which she probably does, and if her non-mortal friends know about it, which they should, and invited her anyways, they should absolutely be charged with reckless endangerment at the very least.

Fuck, the laws can get even messier than they already are very rapidly if they have to account for dealing with "passive auras" that always take effect whether the person with said auras wants it or not...

While I can't do much with the concept as I'm just a writer with almost no artistic know-how, I was thinking that whatever fantasy world this manip is set in, incubi and succubi walk among humans, either covering their bodies completely with breathable robes, similar to a burka (though not an actual Islamic burka as I don't want to offend anyone's relgion, rather it merely has a similar design), only taking them off in either human-free areas, places where they know all the humans are equipped with talismans, or around asexual people, who are immune to sexual auras.

As for this particular human, since he seems reluctant to take her protection, perhaps he snuck into the party knowing succubi were there, and wanted to experience their 'unique' abilities. In which case, he might be the one commiting a sex crime.

Shit... Fantasy law is complicated, man.


Might commission some art around the concept when I have some spare money. Either way I'll probably keep making manips and stories around the concept.

I guess it kinda depends on what the mindset was (and if it could be proved). There's no shortage of people who believe they can handle [anything from spicy food to stupid "hey, let's punch each other!" challenges] until they actually run into it. Definitely reckless and stupid, but I would have a hard time calling it criminal.

On the other hand, if he knew what was in store and had full willingness to take advantage of it with no regards for the feelings of the other person involved on the matter, yeah, that would definitely be criminal.
